  1. Thanks for giving Breksta® mattresses a fair chance & in the low probability your Breksta® mattress just isn't working out after the initial minimum trial period of 30 days up to the 180th day after delivery confirmation and we weren't able to find you the optimal sleep solution or resolution, we can refund your money in full.
  2. Free exchanges or returns are available after you've tried the mattress for at least 30 days from the date of delivery. This gives you ample time to properly adjust to the new materials and allow your body to adapt to the new sleep system.
  3. The 180 Night In-home Sleep Trial can only be used by a customer for one exchange per mattress purchase. However, you can see our Lifetime Comfort Guarantee Policy which helps guarantee your comfort for life!
  4. The trial period on mattresses does not change, extend or shorten once a claim is received and cannot be extended or paused unless willingly expressed by Breksta®.

- NOTE: Please allow "Up To" 72 hours for the mattress to fully fill-in to its corners and settle into its final feel, firmness & height. However, it can be slept on immediately after unboxing.

- We do not exchange for size reasons. It is the customer’s responsibility to measure & verify the size required for the customer’s application needs.

Thanks for giving our Breksta® mattresses a fair chance by testing them for a minimum trial period of 30 days. This will allow your body adjust to the new materials and adapt to the new sleep system.

There are several ways Breksta® can work with you to help you find the best sleep system in the rare event your mattress is not the right fit or in need of adjustments after trying it for a minimum of 30 days:

1st - Modifications to your mattress: Let’s say your mattress is a little too firm but other than that it’s comfortable, Breksta® can provide an additional comfort layer like a topper to help create the desired feel.

2nd - Proper & sufficient support: Breksta® can help you determine whether or not you have sufficient support for your mattress and make recommendations.

3rd - Mattress exchange: Breksta® mattress can work with you to help you decide if another Breksta® Mattress could be better for you and simply exchange your mattress. If you decide to upgrade from one model to another, and we approve you for an upgrade, you may be asked to pay for the nominal wholesale difference in cost which Breksta® may calculate and present to you as an optional resolution. Or, possibly provide or educate on other products that can reach the ideal feel or goal. We can also provide comfort recommendations of products not listed on our site. Standard shipping on all exchanges are free. Prices between mattress models may vary.

  1. In our return process we aim to reduce waste while being mindful of our environmental and social impact. Also, we aim to earn your utmost confidence & satisfaction as sleep experts in helping you find the right products to help improve your life. In the low probability your Breksta® mattress just isn't working out, Breksta® will work with you to donate the mattress to a local charity and/or have it disposed of or removed. Proof of donation / pickup is required for & before your refund will be processed.
  2. Also, to reduce waste and arrive at the quickest possible resolution on behalf of our customers, other additional & mutually beneficial arrangements between Breksta® & customer can be made for partial credits that suit customer needs. These partial credits could be processed alone or combined with other products, services and/or any other number of possible resolutions to customer issues. This agreement would be discussed & reached with the customer & Breksta® on an individual basis. In this case, any mutually agreed-to resolution would be confirmed to customer in writing and bound by that written acknowledgement of agreement.
  3. Exchange / Refund requests will not be approved if the mattress is soiled, stained, damaged or destroyed in any way. You must purchase the exchange mattress, mattress topper or firmness layer. When you receive the exchange mattress, mattress topper or firmness layer, you may initiate the return of your initial mattress or firmness layer for a full refund of the original item’s purchase price.
    1. Stains anywhere on the mattress will void the return / exchange privilege.
    2. Returns / exchanges are for comfort issues only during the initial 180 night sleep trial period and changes or upgrades to size are not covered.
    3. We do not exchange for size reasons. It is the customer’s responsibility to measure & verify the size required for the customer’s application needs.
    4. All materials have scents, but ours hardly have any and if you are extremely sensitive to smell, these naturally occurring scents will dissipate. Our mattresses are made with certified foams and cannot be returned for allergy claims, we recommend a mattress protector to keep dust & allergens out, which we sell in our accessory line.
    5. All Mattresses must be opened within 30 days of delivery or return privilege is void.
    6. International sales do not qualify for our exchange program (these sales are final) unless the international sale was purchased on Amazon. Breksta® Mattress is based in the United States.
    7. Your Breksta® Mattress must be free of damage or stains and used on a non-flexing box foundation or slat surface (maximum 4" gap) in order to be approved for return. Mattresses must be in donatable condition to be eligible for return (e.g., no stains, bodily fluids, tears, bed bugs, soiling, odors, mold, or any other condition less that would make in not sanitary or donatable).
    8. In the case of warranties, trial periods, exchanges, etc: Breksta® services & makes these services available based in the United States and can only be applied if the product is in the United States at the time the claim is made. Because we cannot handle international shipping and logistics expenses, your mattress must be in the United States at the time you wish to take advantage of one of the potential exchange services above.
    9. Purchases made on Amazon.com or with other 3rd party authorized retailers or dealers may be subject to different or additional terms and subject to that authorized distributor or retailer or dealer’s own return, warranty or terms & service policies.
    10. Please retain your purchase receipt for presentation to us if necessary.
    11. Comfort guarantee sales are final.
  4. Breksta® may request some or all of the following: pictures, video of your mattress, pictures of both sides of the legal tag, as well as additional information & pictures about the base that supports your mattress. Once approved for return, we will provide you with a donation, disposal or pick-up option. Return options vary based on purchasers service area & Breksta® works with 3rd party charitable organizations as well as disposal services. Mattresses must be in donatable condition to be eligible for return (e.g., no stains, bodily fluids, tears, bed bugs, soiling, odors, mold, or any other condition less that would make in not sanitary or donatable). Once your return is complete, please email support@brekstamattress.com your donation/disposal receipt to Breksta® for verification & we can then process your refund to your original purchase payment method. Please allow 5 to 10 business days for the funds to process fully back to your account.

Return / Exchange Procedures:

Mattresses:

  1. If you’ve slept on your Breksta® mattress for 30 days, you may initiate your exchange or return request by contacting Breksta® through support@brekstamattress.com
    1. There is no return fee or shipping charge if initiated after the minimum 30 day trial period and before the 180th day from the delivery date of the mattress.
    2. The refund will be issued upon receipt of donation or pickup and returned to the original payment method used (as stated in the Return / Exchange Policy in previous section. While refunds are issued the same business day, it can take up to a week for credit card processors to post your refund.
  2. Please leave us your best contact phone number. Once your claim is reviewed, someone will contact you via phone ASAP to help try to diagnose your problem and determine further action & potential options for resolution. Your claim will be officially recognized on the date it is submitted. In the event of a full refund, you will only be credited the amount you paid and not any discounts applied.

Accessories:

  1. You may return your accessory purchase within 30 days of the date you received the product. Once your bedding product or pillow product has been sent back with its original packaging, received and verified to be in new and unused condition, Breksta® mattress will approve & initiate your refund. The refund will be processed to your original purchase payment method for the original amount paid and not any discounts applied. Please allow 5 to 10 business days for the funds to process fully back to your account.
  2. Mattress support frames, foundations & adjustable bed frames sales are final & non-refundable due to their large item shipping costs.

 

Lifetime Comfort Guarantee:

  1. During the first 180 nights of ownership from date of delivery, the original purchaser may initiate an exchange or return of your mattress for any comfort issue. See our 180 Night Mattress Trial Period above for details.
  2. After the initial 180 night sleep trial, if your needs change, let’s say for example you need a mattress that’s firmer or softer, or you move and need a different mattress size than you originally purchased, for as long as the original owner retains ownership of the purchased Breksta® Mattress and maintains copy of proof of purchase, you may take 25% of your original mattress price off of a new Breksta® Mattress’ current, full retail value price, and other running, promotional discounts or promotions cannot be combined in this instance. If your mattress has layers that are removable and the firmness can be adjusted, you can purchase one from us at a 25% discount off of our current retail price.

LIMITED LIFETIME MATTRESS WARRANTY DESCRIPTION & ELIGIBILITY

Congratulations on the purchase of your new Breksta® Mattress. The investment you’ve made to your health begins now and Breksta® always uses quality, tested materials so you can rest easy. We stand behind our products & customer satisfaction is our goal at Breksta®. We back that statement by warranting all Breksta® mattresses with our Limited Lifetime Warranty beginning on the date of purchase.

This Limited Warranty ( “warrant-y/ies”) extends to mattresses manufactured by Breksta® and purchased directly from Breksta® or Breksta’s ® authorized retailers (the “Mattress/es”). Breksta® (“us”, “we”, the “company”) warrants the Mattress in its original packaging sold to “you” (the “customer”, the “original purchaser) against the defects in material and workmanship set forth below (“Defects”) for the entire period of ownership by you and used by you commencing from the time your Mattress is purchased by you.

Breksta® warrants mattresses and products sold by Breksta® or authorized dealers to the original purchaser of NEW Breksta® mattresses and products. An “original purchaser,” for the purposes of this Limited Warranty, is an individual or entity who purchases the product directly from Breksta® or an authorized retailer of Breksta® with the intent to use the product for personal consumer use and not for commercial or industrial use and not with the intent to resell the product. An “authorized retailer,” for purposes of this Limited Warranty, is an individual or entity authorized by Breksta® to sell product directly to original purchasers. An individual or entity that purchases the product from whatever source with the intent to resell the product is an unauthorized reseller (“unauthorized reseller”). Unauthorized resellers are not “original purchasers” for the purpose of this Limited Warranty. Breksta® warranties are non-transferable and if the original purchaser sells the product, the subsequent purchaser takes the product “as is” and “with all faults.” Proof of Purchase is required for all warranty claims. In the case of warranties, trial periods, exchanges, etc, Breksta® services & makes this Limited Warranty available based in the United States and can only be applied if the product is in the United States at the time the claim is made. Our Limited Warranty only covers and is valid for defects due to faulty workmanship or materials, subject to the details of this warranty and its limitations as listed below & excludes warranty of covers and handles. Breksta® undertakes no responsibility for the quality of goods except otherwise provided in this contract. Warranties become effective starting from the initial purchase date of the product from Breksta® by the original purchasing customer or consumer named on or under the original Breksta® purchasing order or invoice of record. Breksta® reserves the right to refuse repair or replacement of any product deemed to be in an unsanitary condition. Purchases made on Amazon.com or with other 3rd party authorized websites, retailers or dealers may be subject to different or additional terms of service and subject to that authorized distributor, retailer or dealer’s own return, warranty or terms of service policies. Please retain your purchase receipt for presentation to us if necessary & a copy of the original “law tag” label on the back side of the mattress showing model and serial number will be required by a legible photograph. All other claims including incidental or consequential damages are precluded. If identical materials are not available at the time of repair or replacement, the manufacturer reserves the right to substitute materials of comparable quality. Any and all implied warranties on this product shall not exceed in duration the term of this limited warranty. This warranty begins on the day you purchase your sleep set. If your sleep set is repaired or replaced, this Limited Warranty will not be renewed or extended. The warranty for the repaired or replacement product runs from the date of originally purchased mattress. Please refer to MATTRESS CARE DO’S & DON'TS - YOUR RESPONSIBILITIES section of this Limited Warranty for proper mattress care to insure warranty coverage.

WHAT IS AND IS NOT COVERED

Breksta® warrants the mattress against defects in material and workmanship set forth below (“Defects”) for the entire period of ownership by you and used by you. If your mattress has a defect set forth under this mattress Limited Warranty, Breksta’s® sole and exclusive liability (and your sole remedy under this mattress Limited Warranty) will be, at Breksta® Mattress’ option, to repair or replace the mattress, subject to your fulfillment of your responsibilities as set forth herein. In the event Breksta® Mattress chooses to replace the mattress, the replacement will be of the same model and size as the original mattress purchased. In no event will a substitution model be used as a replacement except in the case of a discontinued mattress; in this event a Breksta® mattress of like build and design, at Breksta® Mattress’ discretion will be used as a replacement for the defective mattress.

A proper bed frame combined with a box spring must provide sturdy support for both the mattress and foundation; including a center support and having at least 5-6 legs for queen, king and cal king and 4 leg support for twin and full mattresses.

If you have a platform bed with a semi-flexible slat system or box it won't offer lasting support for a mattress. We recommend a non-flexible foundation, like a box foundation or flat slat system with center supports. You can tell if you have adequate support by looking at the slats—if they are bowed in any way they may have too much flex to provide the necessary support or if you put weight on your box and it is flexible, we recommend getting a non flexible box spring or foundation

What Is Covered:

Deterioration & visible defects & permanent indentations equal or greater to 1 inch that is not associated with an indentation or sag which results from use of an improper, unsupportive or faulty foundation, box-spring(s), base or platform without consistent, wide-spread support at least every 4 linear inches. The indentation must be visible to the naked eye with no weight applied to the top of the mattress

Seams coming apart that are not associated with improper use, abuse or damage

 

What Is Not Covered:

  • A normal increase in softness of the pressure-relieving material which does not affect the pressure-relieving qualities of the mattress. Normal body impression(s) of 1" or less
  • Comfort or Firmness preference of the product
  • Mattress height or dimension
  • Cover (fabric) & handles
  • Physical abuse, damage, burns, stains or soil, bodily fluid, mold, mildew, bed bugs, tears
  • Replacement of another piece in a sleep set unless it is also proven to be defective
  • Damage associated with the mattress being used with improper bed frame, supports, such as frames & foundation without continuous, widespread support of at least every 4 linear inches
  • Merchandise sold “as-is”, “distressed” or by unauthorized dealers, agents, resellers or distribution channels other than purchases made by the original purchaser
  • Breksta® product that has a manufacturing defect and is stained or soiled. For health and safety reasons, Breksta® reserves the right to deny warranty coverage
  • Proper sheet fit
  • Zippered mattress cover or attachment damage due to improper care including removal of cover
  • Normal change in softness and recovery time associated with memory foam and latex materials over time. This does not affect the pressure relieving qualities of these materials
  • Body impressions or sagging in the mattress that measure less than 1" inch
  • Faults in cosmetic appearance such as wrinkles in fabric or perfectly straight stitching, or changes in cosmetics that naturally appear over time
  • A naturally occuring scent from product material - all materials natural or man made have scents, in most cases any minor scents if any will dissipate with time
  • Commercial use of Breksta® mattresses ie; Hotels, AirBnb, rental properties, bed & breakfasts, schools, dorms, shelters, etc
  • All Mattresses must be opened within 30 days of delivery or return privilege is void

MATTRESS CARE DO’S & DON'TS - YOUR RESPONSIBILITIES

Breksta® mattresses are built with a single-sided design. They do not have to be flipped to maintain warranty protection, however we do recommend rotating the mattress from head to foot, 180º every 6-8 months so that it wears evenly and remains comfortable for years to come. We also recommend a mattress protector to keep dust, allergens out of your sleep environment but also to keep moisture and stains off of the mattress which can void the warranty. Breksta® also sells these types of protectors as well as other bedding, accessories and bed frames & foundations for support.

Do’s:

  • Do use an appropriate frame with center support on Queen and King size sets to ensure validation of your warranty.
  • Do check the foundation to confirm its stability and consistent support of at least every 4 linear inches
  • Do use a mattress protector to prevent dust, allergens, moisture and stains that will invalidate the Limited Warranty
  • Do bag / protect your mattress during moving and move it upright on its side
  • Do rotate the mattress from head to foot, 180º every 6-8 months for even wear
  • Do let your new mattress “air-out” upon removal from its plastic packaging. Discard the plastic wrapping on your mattress as soon as possible; a child or pet can become entangled and suffocate

 

Don'ts

  • Don’t remove the white law label on the backside of the mattress that contains serial numbers or the model name label. These labels serve as a means of identification to establish your warranty rights
  • Don’t bend, fold, jump on product as damage can occur
  • Don’t use cleaning fluids on your mattress other than spot cleaning with a small amount of light soap detergent & warm water; it may damage some of the materials
  • Don’t smoke in bed or place product near open flame. This mattress is manufactured, as required by law to resist ignition from lighted cigarettes but not open flame
  • Don’t soak your mattress heavily in any way to avoid mold or mildew
  • Don’t lift your mattress by the handles (if included), they are just for light re-positioning, they can rip under heavy weight or abrupt movement and handles are not warranted for this reason.

HOW LONG COVERAGE LASTS

The duration of any applicable implied warranties, including but not limited to the implied warranties of merchantability and fitness, shall not exceed the term of this Limited Warranty, in this case, the entire lifetime use of the Breksta® mattress for the original purchaser. The Limited Warranty is not transferable in any way. The warranty coverage runs from the original date of purchase and if a replacement mattress is provided, the Limited Warranty continues from the original date of purchase for the lifetime personal use of the original purchaser. The Limited Warranty terms aren’t modified or renewed in any way.

WARRANTY REMEDY - WHAT WILL BREKSTA® DO?

Breksta® reserves the right to substitute comparable materials or models and does not guarantee that the replacement will match the existing piece if unavailable - ie; such as being discontinued.

For approved warranty claims:

  • In the first 10 years of the Limited Warranty, Breksta® we will replace your mattress with a brand new Breksta® at absolutely no charge to you.
  • After the first 10 years of the Limited Warranty, Breksta® will completely repair your Breksta® mattress, or replace it at Breksta’s® discretion. You will only incur a transportation cost of $50 each way.

ARBITRATION

WARRANTY LIMITATIONS, DISCLAIMERS, AND LIMITATION OF LIABILITY

This Limited Warranty gives you specific legal rights. Some states do not allow the exclusion or limitation of incidental or consequential damages or limitations on how long an implied warranty lasts, so the above limitation or exclusion may not apply. You may also have other rights, which vary from state to state.

Breksta® shall not be liable for incidental or consequential damages that result from the use of your Breksta® product. No expressed or implied warranties are extended to persons who purchase the product from anyone other than Breksta® or its authorized dealers, and all warranties to such persons, including the implied warranties of merchantability and fitness, are hereby excluded. Breksta® may require purchaser to provide proof of the quality of the foundation, adjustable bed base, or bed frame used in conjunction with the mattress if purchaser makes a claim under this Limited Warranty. Breksta® may not be able to properly inspect these products and assess to the fullest extent whether coverage is warranted without the help & cooperation of the customer, in which case, Breksta® reserves the right to deny warranty coverage if customer does not cooperate, as well as infestation, health reasons, stains or abuse.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND/OR SUPPLIERS MAKE NO REPRESENTATIONS, WARRANTIES, REMEDIES AND CONDITIONS, WHETHER ORAL, WRITTEN, STATUTORY, EXPRESS OR IMPLIED BEYOND THOSE SET FORTH IN THIS LIMITED WARRANTY AND IN OUR MARKETING MATERIALS OR ARE LIABLE FOR PROCUREMENT OF SUBSTITUTE PRODUCTS OR OTHER SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR RELATED TO A CLAIM AGAINST BREKSTA® MATTRESS OR ITS USE OF PRODUCTS BY YOU OR ANY THIRD PARTY, WHETHER UNDER THEORY OF CONTRACT, TORT (INCLUDING NEGLIGENCE), INDEMNITY, PRODUCT LIABILITY OR OTHERWISE. EACH OF THOSE PARTIES DISCLAIMS ANY AND ALL WARRANTIES OR CONDITIONS, EXPRESS, STATUTORY, AND IMPLIED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU. THERE ARE NO WARRANTIES THAT EXTEND BEYOND THE FACE OF THIS CONTRACT AND BREKSTA’S® TOTAL LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE PAID FOR THE MATTRESS. BREKSTA® LIMITS THE REMEDIES FOR SUCH WARRANTIES TO, AT BREKSTA’S® OPTION, THE REPAIR OR REPLACEMENT SERVICES DESCRIBED HEREIN.

ARBITRATION

In the event a dispute arises between you and Breksta® arising out of this Limited Warranty, such dispute will be determined and settled by binding arbitration between the parties, in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”). More information about the AAA is located at www.adr.org, or you can call the AAA at 1-800-778-7879. Arbitration will take place in Los Angeles, CA.

The arbitration will not be combined with any other proceeding or arbitration against one of the parties. Each party will designate one arbitrator and the two designated arbitrators will select a third arbitrator, who will serve as the chair of the arbitration panel. If the two arbitrators cannot agree on the third arbitrator, then the AAA will appoint the third arbitrator. The AAA may require information related to your product including purchase information. Barring extraordinary circumstances, the arbitrators will issue their decision within 120 days from the date the third arbitrator is selected by the two designated arbitrators or appointed by the AAA. The arbitrators may extend this time limit for an additional 30 days in the interests of justice. All arbitration proceedings will be closed to the public and confidential and all related records will be permanently sealed, except as necessary to obtain court confirmation of the arbitration award. The decision and the arbitrators’ award will be in writing and will include a statement setting forth the reasons for the disposition of any claim. Any dissenting decision will also be set forth in writing. The arbitrators’ award will be final and binding on the parties, and judgment thereon may be entered in any court of competent jurisdiction. You must seek arbitration for disputes arising out of this Limited Warranty prior to exercising any rights or seeking any remedies created by the Title I of the Magnuson Moss Warranty Act. If you choose to pursue any rights and remedies that are not created by Title I of the Magnuson Moss Warranty Act, then arbitration is not required by the Magnuson ­Moss Warranty Act.

Any party who intends to seek arbitration must first make aware to us by sending a written notice of the dispute to Breksta® by mail or e-mail (“Notice”). Please send correspondence to either Breksta’s® mailing or e-mail to:

The Notice must: (a) describe the nature and basis of the claim or dispute; and (b) set forth the specific relief sought (“Demand”). The parties will make good faith efforts to resolve the claim directly, but if the parties do not reach an agreement to do so within 30 days after the Notice is received, you or Breksta® may commence an arbitration proceeding. During the arbitration, the amount of any settlement offer made by you or Breksta® must not be disclosed to the arbitrator until after the arbitrator makes a final decision and award, if any.
